Terms of Service

1. Acceptance of Terms

By accessing or using FridgeFlow (“Service”, “Platform”, “we”, “our”, or “us”) at https://FridgeFlow.app, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Description of Service

FridgeFlow is a household and business food management platform that helps users track fridge inventory across multiple fridges, monitor expiry dates, generate AI-powered recipe suggestions, manage grocery lists, plan meals with drag-and-drop scheduling, track budgets with spending trends, maintain fridges with recurring care schedules, and collaborate with household members. The Service includes AI-assisted features powered by Google Gemini, OpenAI GPT-4o, and Anthropic Claude (recipe generation, kitchen chat with multimodal image analysis and voice mode using Gemini TTS, smart insights), barcode and receipt scanning, Smart Scan photo recognition, community recipe sharing, gamification badges, and notifications via in-app alerts, email (via Nodemailer), and web browser push (via VAPID). Users may bring their own AI provider API keys (BYOK) for household-level customisation. Business accounts (currently available by waitlist) are planned to include multi-location inventory, staff management, waste cost reporting, purchase order tracking, and a developer API with webhook support.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at lewisvillamor26@gmail.com of any unauthorised use of your account.

3.3 Age Requirement

You must be at least 13 years of age to use the Service. If you are under 18, you confirm you have parental or guardian consent to use the Service.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Transmit any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Attempt to gain unauthorised access to any portion of the Service or related systems
Interfere with or disrupt the integrity or performance of the Service
Scrape, harvest, or collect data from the Service without our prior written consent
Use the Service for commercial purposes beyond your personal household use without prior written agreement
Misuse AI features by submitting content unrelated to food management, including prompts or images that are illegal, harmful, or attempt to bypass safety guardrails
Reverse engineer, decompile, or disassemble any part of the Service

By enabling web push notifications, you consent to receiving browser notifications from FridgeFlow. You may revoke this consent at any time through your browser settings or in Settings → Notifications.

We reserve the right to terminate or suspend access to the Service immediately, without prior notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users, us, or third parties.

5. Subscription and Billing

5.1 Free and Paid Plans

FridgeFlow offers a free tier with limited features and paid subscription plans. Details of each plan, including pricing and feature inclusions, are described on our pricing page.

5.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We use PayMongo as our payment processor; by subscribing you also agree to PayMongo's terms of service.

5.3 Cancellation

You may cancel your subscription at any time from the Settings page. Upon cancellation, your paid features will remain active until the end of the current billing period, after which your account will revert to the free tier.

5.4 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Continued use of the Service after the price change takes effect constitutes your agreement to the new price.

6. Your Data and Content

6.1 Your Content

You retain ownership of all content you submit to the Service, including inventory items, household data, grocery lists, and profile information (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to store, display, and process that content solely to provide and improve the Service.

6.2 Data Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

6.3 Data Export and Deletion

You may export your data or request deletion of your account and associated data at any time from Settings → Import/Export. We will process deletion requests within 30 days, subject to any legal obligations to retain certain data.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of FridgeFlow and its licensors. Our name, logo, and associated marks are trademarks of FridgeFlow. You may not use our trademarks without our prior written consent.

Nothing in these Terms grants you any right to use FridgeFlow's intellectual property for purposes other than using the Service as intended.

8. Third-Party Services

The Service integrates with third-party services including but not limited to Supabase (database and authentication), PayMongo (payments), Nodemailer via Gmail SMTP (transactional emails), Google Gemini, OpenAI, and Anthropic (AI features), and Vercel (web hosting). Your use of these integrations may be subject to those providers' own terms and privacy policies. We are not responsible for the practices of third-party services.

When you provide your own AI provider API key (BYOK), you are responsible for ensuring compliance with that provider's terms of service. FridgeFlow stores your API key securely but does not accept liability for misuse of keys you provide.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Recipe suggestions and shelf-life recommendations are indicative only and should not be relied upon as food safety advice. Always exercise your own judgement regarding the safety of food.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FridgeFlow SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

11. Indemnification

You agree to defend, indemnify, and hold harmless FridgeFlow and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time, with or without cause or notice, if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FridgeFlow operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
